Forcible Felony

As explained in Iowa Code §907.3, a person convicted of a forcible felony listed in Iowa Code section 702.11 must be sentenced to a term of confinement without the possibility of receiving probation. Under Section 702.11, the term forcible felony is defined to include any of the following offenses classified in the first degree:

  • felonious child endangerment (except child endangerment subject to penalty under section 726.6, subsection 6);
  • assault;
  • murder;
  • sexual abuse (except sexual abuse in the third degree committed between spouses or sexual abuse in violation of section 709.4, subsection 2, paragraph “c”, subparagraph (4));
  • kidnapping;
  • robbery
  • burglary in the first degree; or
  • arson in the first degree.

The following offenses listed in Section 702.11 are not forcible felonies:

  • Sexual exploitation by a counselor, therapist, or school employee in violation of section 709.15.
  • Willful injury in violation of section 708.4, subsection 2 which is classified as a class “D” felony, if the person causes bodily injury to another.
